The E-2 is a nonimmigrant Treaty Investor visa. You invest a substantial amount in a real, operating U.S. business and actively run it. What makes the E-2 special
- The investment goes into a business. You buy or build a real U.S. company — a franchise, restaurant, store, service, or IT project — and run it.
- Especially suited to entrepreneurs growing their own venture. If you already run or are building your own business, the E-2 lets you move and scale it in the U.S.
- No fixed minimum, unlike the EB-5. What matters is that the investment is substantial relative to the cost of the business, and that the business is not "marginal" — it should generate income and/or create jobs.
- Renewable indefinitely while the business operates; your family (spouse and children under 21) receives dependent visas, and your spouse can obtain work authorization.
